Estate Administration

Melendy Moritz PLLC represents individuals in a wide range of estate administration matters. We also represent closely held businesses, providing them with advice with respect to business succession planning, taking into account tax and estate planning concerns. We plan estates from the simplest will to complex trusts.

We help clients to evaluate strategies in light of current tax law and identify those that best help pass their assets to their beneficiaries with the least amount of tax liability. We confirm that the estate documents are up-to-date, that all of the property is correctly titled and that all of the beneficiaries are properly designated. We also implement strategies that can reduce estate and gift taxes which can include the creation of a variety of trusts including: credit shelter trusts; revocable, irrevocable and inter vivos trusts; qualified personal residence trusts; grantor retained annuity trusts; trusts for minors; and charitable trusts. We can also assist in the creation of guardianships, conservatorships, durable powers of attorney healthcare powers of attorney and living wills.

Melendy Moritz PLLC has experience in dealing with the Probate Courts, the IRS and various state inheritance tax agencies. We will assist the Executor in preparing federal estate tax returns and the state estate tax returns. In our role as counselors we will also provide guidance concerning the amount of estate tax due and the provisions for paying taxes on time. We have experience working with Executors on audits and requests for information from the taxing authorities. Upon completion of the tax proceedings, we can assist clients with the distribution of assets to beneficiaries in accordance with the will or trust instrument and the preparation of appropriate accountings and fiduciary tax returns.
